The U.S. Environmental Protection Agency has recently received a notice of intent to sue (NOI) that may be of interest to you. The NOI alleges EPA has failed to timely act on numerous state implementation plan (“SIP”) revisions pursuant to 110(k)(2) and/or to promulgate federal implementation plans (“FIPs”) pursuant to 110(c)(1) related to the 2015 Ozone NAAQS for the states of New York, Connecticut, Pennsylvania, New Jersey, Maryland, Virginia, West Virginia, Kentucky, Tennessee, Alabama, Mississippi, Louisiana, Texas, Oklahoma, Arkansas, Kansas, Missouri, Iowa, Illinois, Indiana, Ohio, Wisconsin, and Michigan. This information is provided for your information only, and this notice does not require you to take any action.
